Case Description
I have lived in the same apartment since March or April 2004. Over the last few years, I have been very sick and have had a difficult time understanding why I am always ill and fighting coomon colds/flu seeing as I am very healthy (I exercise regularily and eat well). I have recently discovered a leak in my ceiling in my bathroom. I contacted my landlord, who sent the roofer. The roofer concluded that I have an extreme case of black mould THROUGHOUT my apartment and that this is dangerous. He also advised me that my landlord wanted him to "quick fix" the problem, but the contractor refuses to as he believes that the whole apartment needs to be gutted and for the entire roof to be replaced/repaired. The landlord has known of his roofing problems for approximately 2 years and chose to ignore the issue. In addition to this, the unit beside me has had two situations of black mould, which the landlord had quick fixed and failed to acknowledge to me or his other tennants (This building has three apartments). Clearly his masking the problem has not remedied the problem. Do I have grounds to sue seeing as he was aware of the health risks involved in the building? I do have a doctors appointment this upcoming week to determine any type of damage aqs a rsult of being exposed to this toxic condition. I have many more details pertaining to this issue, however, this is the generalized enquiry. Is there anyway I could sue for back rent for the two plus years that he has neglected the mandatory repair work? If I am sick ad require medical remedy, will he be responsible? I will undoubtedly need to move, will he be responsible to pay for my relocation and any other expenseincurred as a result of his negligence? This is a very serious matter that I am needing to address. I havein the meantime contacted the Simcoe County Health Unit and the Landlord & Tenant Board. I will be contacting the City Hall (Property/Building Standards) and the Ministry of Municipal Housing & Affairs. This is a profound issue and I will be negligence tooth and nail! Can you help?
