Description

Law Type:Wills, Estates, Trusts
Location: Coquitlam, British Columbia
Specific Issue: Probate

Case Description

My parents made a mirror will where they left all their possessions and the family home to each other. The wills also read that if one of them predeceased the other then the house would go to me being their eldest son and the rest of the property would be divided between my two sisters and my younger brother. If I were to predecease my parents then the house would go to my younger brother and the rest of the property was to be divided between my sisters. My father died and my mother became to ill to live along in the house. She came to live with my wife and me in the next province and we visited the house once a month to take care of its maintenance. She died last month and I attempted as her executor to prove the will but my brother objected saying that there were many corrections made by my mother in ink. I looked for any subsequent will that was made by my mother and did not find an original will. I did however find a duly executed copy of a will dated subsequent to the earlier will giving the house to me and all the other property to be divided between my sisters, my brothers and my wife who looked after her when she was ill. I need a good lawyer to help me prove this will although I could not find the original and defend any unnecessary objections by my brother
