Case Description
i was working for westside logistics as a truck driver i was ok with the job at the start but as time went on i wasnt to happy with there work ethics.let me get to the point i quit i went to collect my paycheck he's hold $500 back he say incase of photo camera tickets for 60 days and on top of the he's holding back another $600 for a incident that happened in Calgary( i was backing out and a car was parked in a bad spot" even the dispatcher came out and said it was parked in a bad spot) anyways, this is what it has come to....help!!

Sorry my friend, but backing into a car, regardless of where or how it is parked, is a 100% avoidable accident. Did you sign any documents when you were hired allowing Faisal to hold you financially responsible for accidents? If I am not mistaken, you and all drivers at Westside Logistics are sub-contractors. As such Westside is within its rights to withold funds to pay for damages caused by you.
As a Safety Compliance and Liability consultant, I will tell you right now, I don't even need pictures of the accident to find you at fault. Unless you walked around your unit, the car wasn't there, and it somehow materialized behind your trailer, the accident is avoidable and you are liable. I don't think any court would find differently.
The hold back of $500.00 is reasonable. Have you seen how much a photo radar or red light ticket costs to pay? The province takes 15 - 60 days to mail these tickets. Ergo, Faisal is protecting his company from litigation due to your actions.
Methinks you are out of luck, should wait the 60 days and collect your cheque.
