Dispute with Insurance ecompany following an accident

Case Description
Accident in December: writer ticketed for proceeding unsafetly after coming to a complete stop. Disputing this with trial set for Oct 1/09 but have not received disclosure dispite multiple requests. Will request to have the matter dismissed as a result. In the event that ticket is dismissed how to I address assignment of fault, $2500 deductible and injury with the insurance company. Still have the truck that was written off - they will not pay out unless writer agrees to terms as are - accept fault, pay deductible and no further ability to address injuries.
