Case Description
Our neighbors have an easement in their favour, it is their roof overhang. We need help determining whether the easement only includes the overhang or does it include the air beneath it to the roof of our porch.
This is the portion of the deed that pertains to the easement:
"SUBJECT TO the right of the owner or owners from time to time of the Northerly part of said lot to have the eaves which are to be erected on the brick store on the Northerly part of the said lot, to overhang the lands above described."
We would like something in writing to clarify the matter and we would also like to know how much it would cost to retain your services. Please contact us.
