Case Description
My mother had accidental life insurance coverage with TD Canada.
On October 15, 2009 my mother fell and as a result on October 16, developed Septic Shock and was moved to ICU where she remained on life support until her death on November 1, 2009.
I notified the company and it has been a hassel. First they lost the Death Certificate so I resent it and this was just to get the claim forms, whick took 2 weeks. Then when I finally received the forms, they were filled out by the physician and sent registered mail within 48 hours. They lost all those forms, so I had to resend them.
Finally they have them and now they say they are making enquiries, it has now been 4 weeks.
The accidental fall caused the infection that caused her death and according to their policy , infection is covered if it is a direct result of the accident.
Now they are saying because she had preexsisting condition such as diabetes, COPD and heart disease that they are delving into it further.
I think they are looking for a loophole and she was never required to provide a medical.
If my mother had not had the "accidental fall", then she would be alive today.
The physicians report states the primary cause was the accidental fall and of course these other conditions increased her risk of dying but they were not the cause.
I would like to consult a lawyer on this matter. I feel they are trying to get out of paying this claim, looking for loopholes when she clearly fell and developed the infection in less than 24 hours, that rvaged her body.
