Case Description

I was injured at work with a herniated groin in 2008. Went back to work in May 2009 with the injury while waiting for my operation I recieved a back injury and I was diagnosed with 2 bulged disks and 1 herniated disk. While I was off due to the back injury I was given my hernia operation and switched to a new workers compensation claim for my hernia in June 2009. During my operation my doctor informed me that he had cut a nerve in my leg. Since then I have been checked by another specialist who confirmed that I was 1 of 3% of hernia patients who are diagnosed with a problem with the nerve. My symptoms are burning sensation in my groin, nerve twitching in leg, soreness with incision, hip soreness and no sex drive. While I went to the other specialist he advised me that I would have this problem for the rest of my life. When I went back to see the doctor who completed the operation to explain what my symptoms were he "laughed in my face" and stated that I was the only patient who has ever complained about this issue. When I told my case worker about this the case worker stated that I could never be taken off of the claim for my hernia and that the doctor would not be getting away with injuring me further however now they are trying to remove me off of my hernia claim and put me on my claim for my back and stating that I have to go to rehabilitation for 8 weeks. When I asked why I needed to do this the answer was given that they were putting me back on my claim for my back problem and letting the hernia claim go with no resolution. I need to talk with someone who can tell me what my rights are because I have been told by my family doctor, a specialist that was issued by my company as well as my back specialist that I am unable to work due to the problem with my back and hernia. However workers compensation seems persistant to do just that without finding me the help I need to get my hernia problem resolved.
