Case Description

Approx 6 years ago my brother-in-law was diagnosed with esophical cancer. The treatments for this type of cancer are not covered and are extremely expensive. He was only 25 when diagnosed. Family members began to help cover the large cost of his treatments. My husband and myself paid out over $300,000 ourselves. Cashed out everything to help. A year ago things got so bad we began to miss mortgage payments on our house that we obtained a mortgage through Scotiabank back in August, 2000. Had not problems with payments until 1 year ago. Explained to the bank what was going on with my brother-in-law and begged for them to re-write our mortgage and they refused. Now with the house market crash we have no quity to re-write anywhere. Am trying desperately to get the mortgage arrears + legal fees paid to save our house. Had a motion hearing a month ago and it was held over until tomorrow for me to get the arrears. At the time explained may have found a way to get the money and need just a little more time. During this past month both my brother-in-law and me both got the H1N1 virus. We were both extremely sick and this cut into our time to work on getting the monies together. He has found a way to get the money but due to the delay in starting to obtain it while we were sick with H1N1 need just a few more days to get the money together. Afraid to go into court tomorrow and tell the judge need a few more days as he will think I am just stalling. Swear this is not the case. Unsure how to handle this which is really stressing me out. I have been honest and up front and never avoided what was going on. Kept in touch with the bank and the banks lawyer throughout. Just need a few more days for the money to be transferred. Please help me in how I should handle the motion hearing tomorrow. We need a real estate lawyer.
