Case Description

I was working in a job where I knew I would be laid off on Feb.11, 2010. On January 19 I received a dr's note to be off for one week due to an injury. On January 20 my employer called me. In discussion it was decided that she was going to lay me off. She stated she needed to staff the clinic while I was off with my injury and that my position would no longer be available after. I objected but said I understood from her perspective.
Following this, my employer stated that I had quit my job during this conversation. I did not quit, and she has no documentation of same. I sent her an email expressing my hope to return and complete this job prior to this phone call.
I asked for the ROE to reflect lay off and for my compensation of termination with no notice. She felt I was not entitled to same.
We were unable to resolve our dispute. On Jan. 30/10 I filed a dispute resolution with my employer. On Jan.31 she sent me an email that my job was available- with no guarantee of work on a casual basis. I replied with concerns that this would be a hostile environment to return too. Upon receiving this email she has asked me not to contact her or her company again. I would like to consult a lawyer on my legal options.
