Life Insurance Refused

Case Description
My sister's fiance committed suicide on 10/23/09.
He held a policy with The Equitable Life Insurance Co of Canada, she was the beneficiary.
His payment was in arrears at the time of his death (unsure when the last payment was made, but not more than 60 days prior).
This policy had been in force for over 10 years.
The grace period is 31 days (as stated on policy).
Even if this period was exceeded, would his state-of-mind not come into play here.
We would like to discuss our options with lawyers. Please help.
