new home builder issue

Case Description
We built a Mckee home 2007 during the one year warranty period we called them out to look at the shingles on the house as we thought they looked different in color than those on the detached garage. They came back and said that yes they were the same color it just looked different because of the pitch of the roof. They were a very reputable builder & we believed them. This August we had a very bad hail storm so I had a company out to look at the shingles & siding for damage. They said everything was fine but then stated do you know you have two different colors of shingles. The correct color is on the garage. An estimate given to us to replace the incorrect color on the house is $12300.00. I have contacted the company & they refuse to do anything. I'm am worried that when we sell our house it could be an issue, thus not allowing us to collect full market value. I would like to take legal recourse. I do not have documentation requesting the first look, but I do have the original work order showing which color shingle was requested.
