Case Description

Subject: Causation of personal injury to a young patient by the overt act of a doctor of a dental clinic, without seeking consent or permission from the child or her parents.
Respected sir,
It is submitted that my daughter aged 8 years accompanied a female relative to a private dental clinic in Toronto where the relative got engaged with a staff member of the clinic in getting her teeth treated. The said child who was left in the waiting room was advised by another staff member of the said clinic to get her teeth examined for proper care in future. The said doctor forcibly extracted four teeth of my daughter in an unskilled manner without prior permission of the parents or even the child herself. This overt act of the doctor badly injured the entire vocal cavity and even caused damage and infection of the ear with severe fever and shivering; the child was rushed to the emergency wing of a nearby hospital.
As a result of the above most uncalled for and impertinent act of the clinic staff, my daughter has constantly been in a state of shock and confusion. This is a case of PERSONAL INJURY caused to a person by the negligence and incompetence of the surgical staff of a private dental clinic in an unwarranted surgical procedure, without prior permission and consent of the parents or the child herself.
In the circumstances we may have a genuine ground to file a suit for damage and claim compensation under the provisions of Tort Law of Canada.
I, therefore, request your benign person to guide me about the procedure and legal course to be adopted in pursuance of a proper action against the said irresponsible doctors and get necessary damages for the injury they have caused to the child.
It is also requested that information may also kindly be conveyed about the possible expenses which will incur, the time it will take and the compensation we can hope to get.
