Case Description

I purchased a new home from a builder who is now bankrupt. The house is two years old and has major structural issues. The basement is crumbling. Tarion warranty is dragging their feet. In the mean time I had a company (engineering) come in and look at the basement. Their coments was one of the worst they have seen, in their own words. The house is sinking into the ground. Upon further investigation we found that the house had no permit to be here. No inspections were completed city or otherwise. I hired a home inspector to go over the house and he has found a bag of bugs. I really think I need a good construction lawyer to help me through this, because this house is worthless and falling apart. In the words of the engineer, "even if we stabalize it, the soil in this area is SO BAD, there is no guarantee it won't happen again". How's that for a comfort level? I am fearful Tarion is playing games, the city will not take any level of responsibility, saying its the developers responsiblility and then the developer is gone, so we have no where to turn. The engineer said the repairs to the basement will be about 80 thousand dollars. We paid $250 for the house. There is issues all over the house, I have to put shims under the fridge and the kitchen island because they tip forward. This is a mess and I think I need a lawyer to help me get my money back or enough money to cover these ever mounting costs. I live in Welland, Ontario
