Case Description
I live in edmonton alberta. Last Nov i was in an accident not my fault and have police repoert to prove. Found out few day in the guy at fault was driving with invalid insurance. Being my car was only $3000 i didnt get colision on my car so my insurance wouldnt help me. Tried negotiating with this guy all he did was give me the run around. I then filed a small claim against him claiming price i bought my car at 3 months proir, have bill of sale still. and the cost of towing and storage of my car for 5 days when i finally had to write it off the car myself because was costing me daily and he failed to come look at it or make a descision. anyway. i served him, and he came back with a dispute saying my cars only worth $900. today we had mediation, he failed to show up. I guess i have a few questions. Im not a being gready at all here and im more then understanding, its more the opposite that i should be claiming for more. For valid reasons of course. Such as 2 days missed work without pay, and a bit of emotion distress. When i went to dr to get checked out from accident i was prescribed anti depressants. I can honestly say this has put a great deal of emotional distress on me. They have put in forms to set a trial date. Is it to late to ask for more. or how would i even claim for something like emotional distress?
