Vehicle Deemed as a total loss

Case Description
My common law spouse was in an accident and the vehicle he was driving is deemed a total loss. It was a leased vehicle so the negotiations between our insurance company is with the leasing company. But we have an endosement 43(depreciation clause) and full replacment value as well. The insurance wants to settle with the leasing company for the amount of the vehicle before taxes. In the endorsement 43 it states that the taxes need to be included in the amounts. The insurance company tells me that they do pay the taxes on leased vehicles. I would like to consult with a lawyer on an hourly rate base on my recourse if they settle without paying the taxes.
