Description

Law Type:Accident & Injuries
Location: Caledon Village, Ontario
Specific Issue: Medical Malpractice

Case Description

My dog was taken to an Emergency Vet Clinic for a C-Section as a puppy was stuck. The Vet performed the C-Section and I had two live pups. I asked for antibiotics to give the dog (normally given Clavamox as it doesn't effect puppies)but was refused.
Five days later my dog was back at the Emergency Clinic but this time because all of her intestines were completely out of her body and near death. I assumed that the stitches had given way. Before the Vet operated on my dog to put the intestines back in I was presented with a large bill which I refused to pay as I stated that if the job was done right that my dog would not be there. They stated that I had to pay something because they couldnt operate unless I did. I paid them 300.00.
During the operation the Vet came out to tell me that it wasn't the stitches giving way that caused the large whole in my dogs belly but that she had a major infection that was eating away at her flesh and in order to save the dog that she would have to be spayed. I agreed to have her spayed. She remained at the Emergency Vet Clinic for 3 days when she was transferred to my regular vet because the clinic was closing for the day. My dog was on intravenous drip while at the Emergency Clinic and they told me they had to reduce the drip because she was filling with fluids. Well these fluids caused her to have major Heart Disease and her life span has been severally shortened. My vet had to remove 1/2 litre of fluids from her. She is a 2 year old dog. Not only did their actions end her breeding career but more importantly has given her an early death sentence. She will have to be on expensive medicine until she dies.
The Emergency Vet Clinic has never contacted me since they took her to my regular vet. I have been under a lot of stress and can't get the image of my dog's intestines outside of her body. All of this could have been avoided if I had been given antibiotics to give her. I would like to know if I have a case to sue them and if so i NEED A LAWYER FOR THIS.

I think you will find that it will be difficult to find someone to take this on unless you are prepared to pay an hourly rate.
The damages are likely not enough to warrant a contingency fee, unless this is a champion breeder and there is a significant economic loss component.
You should probably file a complaint with the Veterinary College against the doc.
