Case Description
I wrote a book on a famous ice hockey coach. I received a notice for copyright violation from another author. The author claims I had plagiarized from her book and that I have to pay her a fee for quoting from her book and damages. I admit I read her book during my research but the portion she claims are plagiarized are all fact based and I believe facts cannot be copyrighted. The other portions she claims are plagiarized are quotations of the subject of the book. The ice hockey coach should have given me notice for copyright violation if using his quotations can be called plagiarism. None of the quotations are stated by the author who accuses me of plagiarism. I need to fight this unreasonable demand. I require the help of a competent intellectual property legal expert to make out a good case for me so that such frivolous attempts at getting damages will not be made.
