Case Description

I am an American citizen working for a Canadian company on a NATO Base in Afghanistan. I recently had a neck and back innjury on the job and was seen by the medical providers on base. It was determined that I needed to go out of Afghanistan for further evaluation and treatment. At this point is where I thought it was my right as the injured worker to choose my doctor, one I beleived would have my best interest at heart, and one that I trusted. I was informed by my company that I had to go see the doctor they appointed in Dubai, and refused to let me choose who I went to see. I found documentation that showed it was company policy that the injured worker had the right to choose his/her doctor of choice. I also looked at Canadian, US, and Defense Base Act laws, all confirming that it was my right as the injured worker to choose who I saw first. Then, if the company wanted me to see a different doctor of their choosing, they could ask for an "Independant Medical Evaluation". I showed all documentation including the company policies, but was still denied my rights. I was sent to see their doctor in Dubai. When I showed up for the appointment, I was told that I needed to cover the expenses. I felt that I should not have to cover the expense of seeing their doctor, but out of good faith, anf that I also wanted to know what was wrong with my body, I went ahead and paid for the appointment. Their docotr said I would need extensive physio therapy for my injuries, and the company did not like the outcome, so I sat in a hotel for 12 days while they decided what to do with me. Finally, a doctor from International SOS called me and asked how I was doing, I explained what was going on and he said that the company was trying to get him to reccomend for me to go back to theater for my treatments. He said that it would be irresponsible, and unproffesional to do so. He and the doctor they sent me to requested that I be sent home right away for treatment. After getting home, I never got any documentation to start my treatment, I had to go on my own on self pay to receive treatment. Now, after 1 month, the private insurance has paid me for time loss, and said they would cover my meedical costs..... So it seems all will work out?? My question to you is, were my rights violated when the denied me to see the doctor of my choice, making me go to see theirs first, then making me sit, and having me pay for the medical appointment. If so, what are my options.... In advance, thank you for your time and assistance on this matter. With Regards, T.
