I am wanting to divorce my husband, we have been separated for over 1-year. We have a separation agreement that we agreed to without legal advice due to him being in court with his ex for 8-years. He originally agreed to the divorce and agreed to pay for it, but now he won't give m and address to serve him and he has changed his phone number so I can't get hold of him. What can I do? What do I do? I paid him out and gave him more than what he deserved considering our history. Please help.

Date : 19-03-2010

I am looking for an inexpensive lawyer. I have a child and would like to move out of the city but her father won't consent. So I do need to fight this in court and would like to have a lawyer representing me. As her father has alot more money and can afford a very high priced lawyer. There are a few other things that I would like changed in the parenting order we have as well. He doesn't pay his full child support and is now being inconsistent with seeing his child. Any help from any lawyer right now would be good as I have done everything possible to keep this situation from escalating but unfortunately this is unavoidable at this time. And he is making life very difficult for me and my child.

Date : 19-03-2010

during the month of October i went to the foothills hospital on 3 different occasions complaining of pain in my right leg. On the first visit to emergency the Dr said i would have to have an MRI and my family Dr. would have to book the appointment. I went to my family Dr and he arranged the MRI for OCT 20. He prescribed some pain medication and stated that we would have to wait for the MRI results. I again ended up at the Foothills hospital and was accused of drug seeking and given pain medication and released again. On the third trip to the hospital i was again released and told by a Dr. Berlin to not return until I could no longer walk. I was using a walker to walk by this time as the pain was so great i could not walk without assistance. My family Dr did not know what to do as there was no outside hint or swelling. I saw him again on the 18 of Oct 2009. He said to wait for the MRI. I went home and went into a coma on Oct 19 and my son called an ambulance and I was transported to Peter Lougheed hospital where I underwent surgery for a septic leg. I was released in the middle of February and am still under care as my leg is still infected and I will not be able to work until it is healed. I also had an operation at the foothills hospital previously to this experience to repair a hernia and my bowel twisted and I was bringing up feces. When I went back to the hospital they would keep me for a couple days then release me without any testing to see why I was bringing up feces. This went on for about a month until the twisted bowel untwisted itself.

Date : 19-03-2010

I have some concerns over fraud. I am interested to know if there are any ways to mitigate fraud through the courts (ie. making a formal statement). I have a legal will and am aware that probating that will may serve that purpose (at least, in death). I am, of course, also interested in documentation which may would protect from fraud (specifically verbal agreements, but also forged materials).

And so, a probate may be appropriate, and I need to go about getting my will probated. Please also advice me on the applicable charges.

Date : 19-03-2010

While purchasing my home, my income was low and could not qualify for mortgage. I had an ongoing relationship with a man and he offered to sign as my guarantor.

I arranged for the down payment from my family and also paid the mortgage from my own earnings. When after 5 years I qualified for the mortgage, I took his name off as he got involved in a lot of wrong things.

When later on I tried to sell my house, he put lien on it and later put a claim on the profits of the house. In other words, when the house is sold I would get my investment back and he would earn all the profits.

Furthermore, he claims that I had made a verbal commitment that I would give him the profits of the house. I have never made any such commitments to him for standing guarantor. He further claims that there were two witnesses when the commitment was made.

Will I lose my property to him? Please help me.

Date : 19-03-2010

I am facing theft under x3 uttering threats and numerous breaches in accordance with the aforementioned charges. I need consultation and representation on these charges and to the following questions:

generally what kind of time does the crown ask for on these charges?
If the crowns witnesses do not show up can they still proceed?
if the charge is withdrawn will the breaches to that offense also be withdrawn?

I was charged with sending an email to a mosque from my house. I have no memory of sending it, probably sent by my friends kids I let play on my computer.

Never the less, it was not a threat, it just said 'obscured'.

I had to get cops come to my house and ask if it was my email. I said it was figuring they would never arrest me.

I was charged with mischief.
I went to court and the cops dropped the charge, and I was free to go.

Then I got a summons that someone in the mosque was sending me a private charge. TO get rid of complications I had to hire a lawyer.

I want to sue the people who brought these charges on me, pain suffering, loss of work to go to police station etc...
Im willing to put down up to 5000 thousand dollars as a retainer if you think I can get any money in small claims court.

Date : 19-03-2010

I was a retail auditor with in BC. My role was to perform audits in the BC / Lower Mainland.

I think I was good at my job and received complements from my immediate boss for being professional and diligent in my duties.

However, these are the circumstances that led to my wrongful dismissal:

1.	During my rounds of audits, I encountered a retailer in Squamish who was not happy with my assessment for the previous period. He is of middle eastern ethnicity and I am also a minority which makes us similar in appearance anyways.
a.	During the audit, the retailer stopped me in the first few minutes and asked me if I had any experience in doing audits. I told him that I was thoroughly trained and had completed at least 100 audits during my tenure with no complaints. He started berating me in front of his customers and said that I was incompetent and should not be allowed to do such a complicated job.
b.	Next he stated in plain terms that this job should be done only with a ‘white’ person. He stated that ‘brown people should only use brooms and mops’. He also stated that he would do everything in his power to get me ‘fired’ by my company.
c.	He asked me to stop the audit and I left in shock, humiliation and disbelief.
d.	I immediately called my boss from my vehicle and he stated that this was a serious matter and that he was going to stand behind me to the end.
e.	I completed my rounds of audits for the period and left it to my boss to handle internally.
f.	As I was prepared to conduct my latest rounds of audits for the next period, I asked my immediate boss what transpired with the location that I had voiced my opinion about. I mentioned that a friend of mine, who is an attorney in his country suggested that this conduct was highly illegal and discrimination is a very serious matter.
g.	When I mentioned this to my boss, he was fine with it and said that we should deal with it internally, which I agreed to. After getting off the phone from my immediate boss, the director of the company called me and told me that the company was ‘angry’ and this matter was serious against ‘me’. First, I did not contact the parent company and second, I just asked what the best course of action would be.
h.	He said that he was going to review the ‘tapes’ for the location and get back to me.
i.	He called me later in the week to tell me that he was firing me because allegedly I spoke about the incident to other parties which was not true. He didn’t mention anything pertaining to the discrimination and humiliation I received on the job.
2.	My complaints include discrimination by an employee of (the retailer) which was collaborated by my boss and being wrongfully dismissed for a fraudulent reason that is impossible as I did not discuss my situation with anyone since it was embarrassing to me. I know for a fact that many of the locations have managers or owners who are related or simply good friends, so it was an attempt by the retailer from Squamish to ‘get me fired’.

I hope you can help me with my case and seek a remedy and damages for my loss. I have lost my income and my emotional state is diminished considerably.

Date : 18-03-2010

I want to file a suit for a Condo that I bought. The salesperson misrepresented an insuite laundry unit and even had a demo unit within the suite. We also had a covered parking space allocated on our purchase contract. The Strata refuses to release the space that we paid for and it is impossible to integrate an insuite laundry. Lastly, the Strata refuses to provide any of the amenities as per the contract agreement. My tenants have left and it is impossible to sell this unit based on the parking and laundry issue. Now I am facing foreclosure as I can't sell or rent this unit. I would like direction on filing in court and how much damages I should go after. My credit has been ruined by this and I have spent thousands maintaining the payments.
Thanks,

there is no way for them to prove I stole even though they found it in my possession.

I have 2 grandsons, they have taken from their mom for abuse and neglect. They were placed in foster care and eventually went to live with their fathers (different fathers). My oldest grandson was removed from his father last week because he was hitting im, neglecting him and verbally abusing him. My youngest grandson was taken from his father also last week when he called the department of HRDC and told them he didn't want anything more to do with him.
The oldest is possibly going to be returned to his father if he can prove he has taken steps to become the parent he needs to be, and the youngest is possibly being put up for adoption.
I would love to be able to take my grandsons to live with me, whoever i have had dealings with the HRDC and that puts an X on me, i have applied for an exemption because none of my case was due to abuse or neglect...i called them for help dealing with behavior issues and now i am marked for life.
I am the only person in their lives who is related to both of the boys and would keep them together, my financial situation is not the best and i can not afford a lawyer and do not qualify for legal aid. I need help or suggestions of any kind that may help me in bringing my boys home to a family that wants them and loves them...PLEASE HELP

Date : 18-03-2010

I want to file a statement of claim against a company with a registered address in St. Catherines, ON. The claim will be for breach of contract, fraud and illegally operating a business.

I need guidance on how best to proceed with the flow of activites including:

1. Filing the claim. I am in BC but the company is in ON. Where do I file it?
2. If the defendant fails to respond, how can I get a judgement against them?
3. Once I have a judgement, how can I commence collection action after registering the judgement?
4. How long does each process take?
5. Is it best to have a process server file, serve and register the aforementioned court documents and orders?

I would like to do this ASAP and hope to get some guidance shortly.

Thanks,

My wife and I have lived in the same condo apartment for 6 years. During the last 3 years we have noticed a quick deterioration of the drywall around windows, rusting of window frames and the growth of mould. At our expense we bought and use a dehumidifier in the room that is directly over the sauna and pool...but that doesn't do much.

We have contacted the property manager, but they have not responded. At this point, we are ready to move out as we have two young children that are always sick (as evidenced by the numerous trips to the doctor and the doctor asking us to check our air at home) and we are afraid of both the potential short and long term affects of the extreme moisture, mold and chemicals vapourized from the sauna and heated whirlpool below our unit. We are considering having a CHMC designated inspector come in to tell us affirmatively that we need to get out. WE would like to take legal recourse if any for personal claims.

Date : 18-03-2010

My husband and I have been separated for 6 months. We were married for just over 2 years, in a common-law relationship for roughly 8 years. My husband is wanting debts split equally. In his calculations, he figured out that he has roughly $x more debt than I do in his own name and believes I should pay for half of it. My questions are:

1. Is he able to include debt aquired prior to our relationship (ie. Credit Line with his parents co-signature)?

2. What about an RRSP that I took out under the Home Buyers plan for down payment on a house, should that be included in my liabilities?

3. Also, he has included the loan amount for his vehicle which he is keeping?

We have recently sold our house and he believes that he should receive all profits and that I owe him money for his debts. Also, I am an RN who has not worked since our separation do to anxiety/stress BUT I do not want any spousal support, I just don't want to have to pay for any unrequired debts of his.
Any advice would be great!

Date : 18-03-2010

Suffered a lower back injury on the job in October 2009. Since that time, employer has laid out numerous "modified" duties that have not been within the scope of my abilities. Doctor has now twice stated that I should not be working until such time as I am medically cleared. I have tried all the duties as I am obligated to under the law. I have challenged those that have been outside of my abilities. In February 2010, a meeting was held with WSIB Return to Work Specialist, employer, union, employer's representative from Deloitte and myself. ESRTW agreed to. Lasted one week and employer arbitrarily changed duties to work not within my abilities. Suffered a re-injury (this was the 2nd time Doctor ordered I be off work in order to heal properly).I have been taking time off without pay, pending WSIB decision. Now employer says they have work for me and advise that they are giving me the same duties that resulted in re-injury. They have advised that I am to start back to work Saturday, March 20, 2010. I have also just been advised by WSIB that another Return To Work meeting is scheduled for Thursday, March 25, 2010. Should the employer legitimately expect me to return prior to the Return To Work meeting? The duties involved are also the subject of a pending grievance for failure to provide proper accommodation. I also view my employer' actions in this matter as being punitive. My schedule has changed 7 times in 6 months. My duties are continuously changing, these changes being made arbitrarily by the employer with no formal update to the ESRTW. All I want is time to heal, and both WSIB and my union repeatedly tell me I must do whatever work the employer has for me, and if I do not feel that it is within my abilities, I can refuse based on my rights under the OHSA. Given all that has transpired, I am of the distinct impression that my employer's goal is not my Early & Safe Return to Work, but to get their incentive by averting a WSIB claim and to keep their premiums down. If I decide to take the time to heal (regardless of any decision by WSIB for LOE benefits), does my employer have to re-employ me when I am medically cleared to return to work?

Date : 18-03-2010

On January 10th 2010, I have requested a meeting with my new CWO to discuss some of my concerns and changes that happened after the old CWO left. He said that we can meet up after my twelve hour night shift. During the shift, I wrote to him asking if we can reschedule the meeting, since I felt really tired and thought that rescheduling the meeting would be best.

When my next shift came up on January 13th 2010, the new CWO called the gatehouse and asked me to meet up with him after the shift, I agreed. At 0700, he asked me what seemed to be the problem and I tried to explain to him about the patrol being changed and some of the safety concerns. He said that there is nothing to talk about and that the client approved it.

He also wrote me up for not showing up for the meeting that I had requested before. I refused to sign it since I thought it was a wrongful Accusations.

I said to him if he didn't want to hear what I had to say then it was fine. I was just making some suggestions. He at that point said if I would like to transfer to somewhere else, since I wasn’t happy here and the schedule was better. Under the impression that if I didn't take this post I would be kicked out of the site. I agreed and I also asked if I can stay here if I can get the morning shift, at which he replied “No, since the client doesn’t want you here since you complain a lot”.

He also said that he talked to someone about the transfer. They weren't happy about it but he agreed to it.

After the meeting ended at 0720, I went home. A Human Resource representative called me saying that I would have to come downtown and talk to a gentleman. I had asked if it was about the transfer. At which I got a reply "No. They had no idea about the transfer I was talking about". Later on that day, a gentleman contacted me.

I told him what they said and that they agreed to a transfer. they saud to
me that he spoke to them nd that the transfer will not go through.

On January 18th 2010, I had talked to Mr., he said that not showing up for the meeting is a serious offence here, but I also told Mr. that I rescheduled the meeting with Mr and that nobody told me that I would be written up for a something that was already rescheduled.

After the talk with Mr. , he took me to the operation centre to find me a new posting. The Operation center personal, he would
put meon a temporary position not a full time position, downtown. At that time it was ok until my brother told me that I could not take his car downtown because he didn't feel comfortable me taking his car there. I told the operation center that I can't do the hours 5PM till 2AM since I will have no way going back home to Maple, where I currently live. During the week, I kept calling the Operations Centre to find out if there is any full time position available at which every time I got a reply of "no full time positions are available at the moment”.

After 3 weeks of not working, Mr called on February 8th, 2010 saying the reason I can't get a position is because I had not returned the id badge back .

I returned the badge on February 18th, 2010. Finally on February 27th, 2010 I was offered a position for one shift. I declined this as I was promised a full time position. This shift was only a one time shift. I was promised full time.

Today I still have not received a word that I will be givin a full time position or even any hours to live. I am now considering going on unemployement as I have no other option.

Date : 18-03-2010

I have moved out of a home that I owned with my ex and forgot to remove the alarm system. My name is on the contract now and he is refusing to return it if I don't fix the holes in the walls. I didn't sign the initial contract to have the alarm system installed, he did, so I don't feel that I should have to pay for the walls to be fixed. In order to get out of the contract, the system has to be sent back. I first had them send over a change of information form (back in August) so that he could put it back in his name which he did not fill out. I also had them send a prepaid weigh bill so it would not cost him anything to send it back and he refused unless I agreed to have the walls professionally finished. I would like to ask for the system to be returned, monthly payments made to the account since August to be returned to me and lawyer costs.

Date : 18-03-2010

Have filed my 2009 late last year due to a letter from Revenue Canada claiming I owed $2,900 from previous years. By the time I investigated with H&R Block and discovering that this had already been paid up (was not communicated properly between the assessment office and collections at revenue Canada) and was not in fact owing. This caused me to be late in filing 2009 with H&R Block which I was okay with since I had a refund coming all along. While my 2009 claim was approved by the assessment office (which I have the assessment of $3000.00 refund it was given to the collection department. Over 4 months later I questioned where was my refund through H&R Block. H&R now advises me that Revenue Canada Collection dept are just now assessing a penalty of over $3000.00 (coincidentally tied to my refund amount). Reason given is " due to the rental statement in my claim being late" even though I had a refund coming back and the rental statement showed no income rather a loss. However I still have not received any communication on this from Revenue Canada. I guess they can act as they please and make up penalties as suites them. Also I have dealt through H&R Block for over 10 years and have never been advised on any potential penalty on late rental statements. This seems an abuse of power and extremely unfair due to the root cause of it being late was due to Revenue Canada error in sending me a $2900 claim with no back-up. I need consultation from a tax lawyer near by.

Date : 18-03-2010

Hi. We supplied General Coach with window treatments for their trailor production. SAles dropped and the CEO decided to purchase all window treatments from their other supplier and asked us to ship all our inventory of supplies. We shipped as requested and them he decided to cherry pick and refuses to complete payment. This is the third time he has changed his mind and each time it has cost us money. More about the principle than the money ( $7,000). They signed a receipt, confirmed the verbal in an email of his secretary. Now is is slip and slide to wiggle out of paying. This is the short version but in general a quick summary. We need legal guidance and recourse from a business lawyer in recovering this money.

Date : 17-03-2010

My father passed away in Alberta two days ago. My brother and I are his only children and we are adults. My parents were divorced and my father has been living common law for approx 8-9 years. Our relationship with our father has been strained and we have not spoke with him for approx 8 years. In Nov 2009, I was able to locate him with the help of the RCMP. He informed me that he was very ill but that he did want to reconnect with my brother and I and have a relationship. Now that he is passed, his common law has instructed the funeral home not to give us any information, she's totally shutting us out. We have called the estate lawyer and she has informed us that we are not included in the will at all. The common law is the executrix of the will.
We don't know how long ago dad made his will, did he have life insurance, is she entitled to everything, can we contest the will as we are his only blood children. His intention, so we are told, was to visit us and reconnect our relationship this spring. Can we do anything or have any rights?
At the present time the funeral home has agreed to hold my Dad's ashes for 5 business days and not release them to anyone else as we are his children. Please, we are desperate and do not really have the finances to put up a big fight but want to know our rights.
Thank you

Date : 17-03-2010
